The Importance of Correctly Documenting Witness Information
I gave that information to the police officer. Sound familiar? I’ve had situations recently where I’m getting a number of cases where people are involved in personal injury cases, mostly motor vehicle accidents that are investigated by law enforcement and somebody at the time of the car wreck says, I saw everything that happened. Here’s my name. Here’s my phone number. I can’t stay around for the police officers, but please go ahead if you need me and let me know. You’ve got my information. Okay, that happens.
Now you give that to the police officer. This case I was talking about happened last week. I was having this conversation with a client and I said, okay, what was the guy’s name? Well, I wrote it down and gave it to the police officer. What was his phone number? I wrote it down, gave it to the police officer. Don’t do that. Give them the information to write in their own report and then get the information back.
Importance of Accurate Police Reports
I worked in law enforcement for many years as an assistant DA in a variety of counties and I can tell you the quality of a lot of the police reports I’m seeing right now. There may be many witnesses to a very severe accident and their names are not being gathered. Their contact information is not being gathered. So if you have the physical ability, if your faculties are such that you can do it, write down the names of everybody. Better still take pictures of all the people that are there, witnesses, because who knows? You may not have gotten their name, but you get their car. You might even get their tag number and then maybe we can find a great, crucial witness for your case.
