Understanding Negligence
What is the recipe to cook up a dose of negligence in a lawsuit? I’m Mike Ashworth, TulsaPersonalInjuryLawyer.Pro, 918-924-5528. What’s the recipe? Well, in Oklahoma, things are broken down into elements, or I call them recipes. Negligence has a recipe of eggs, flour, ingredients of that type. The items that you put into that negligence omelet are there’s a duty, there is a breach of that duty, that as a result of the breach of the duty, there’s causation of damages.
Now, this is where it gets really, really frustrating. You may have a case that sounds really good and really strong, and you may consult with all kinds of lawyers around town, and you’re going to get a similar response to what I’m about to share with you. Man, I feel bad about this. You absolutely do have a cause of action or a claim, but unfortunately, you have no damages.
Now, you say, unfortunately, that’s really two-edged sword. I mean, who wants to say, well, unfortunately, you weren’t hurt bad enough for me to be able to do anything about this case? But the bottom line is this. In legal business or the legal profession, if you do not sustain damages, you do not fulfill all the ingredients of negligence. So, duty, breach of duty, causation, and damages. Now, that’s why it’s so important. Go see a doctor immediately because you may have some damages. You just may not know it. But damages is not, well, my back kind of hurts. Damages are, you go get checked out. Yeah, you’ve got a strain, you’ve got a sprain. You may have some more serious injuries.
