The Elements of Proving Negligence

Number one, what do I need to prove if I’m injured due to someone else’s carelessness in Oklahoma? Well, the word that is normally used is not carelessness. It’s what we call negligence. Negligence is the most common thing that comes to mind in personal injury law. It means there has to be a duty that someone has to someone else. There has to be a breach of that duty. In other words, a violation of the duty they had to someone else. There has to be damages of some kind. Not that, you know, I scraped my knee or I’m upset or I shouldn’t have to go through that. But real true measurable injuries.

And then the last element is we have to prove that the duty that was owed, the breach of that duty or violation of that duty, caused the damages that you suffered. That could be economic loss like lost wages. That could be hospital bills. It could be medical other types of medical bills. It could be, for example, if you have a dog that got damaged by somebody else’s dog who attacked him, it could be property damage. But you have to show that there’s some connection between the breach of that duty and damages.
