You’re at an athletic event, having a good time, they serve beer and you have a beer on your own, no big deal, but you notice that a lot of people are having beer. But at this athletic event, and I use this example because years ago I went to a bowl game, the beers were huge, massive, massive beers. And there was no basic monitoring, it wasn’t like you had a bracelet and they had to punch it that you had your two or three or whatever the limit would be.

An individual had had several at this bowl game and they’re coming down the stairs at the stadium, it was a football stadium. And they were loopy and wobbly and they fell, and they fell forward ramming into the back of some fans at the game, causing them to be injured by going forward into the bench ahead of them, causing some knee injuries, some upper body injuries, some back injuries and things like that.

Liability of the Parties Involved

The question is going to be who’s liable? Who’s going to pay for that?

Well now obviously the person who was intoxicated should be held accountable because they had a duty not to get falling down drunk in a crowded place where they could present a danger to other people. But what about the marquee operator? What about the operator of the stadium and more specifically, what about the vendor who has the contract to provide the beers?

Now most states have laws that said that if you are serving an individual who is noticeably intoxicated, you have a duty. The duty is not so much to that individual, if that individual wants to get schlockered, they can do it to their heart’s content, but as a matter of public policy, if you’re the one serving the individual to the point they get schlockered, then your duty is to protect the people out there, the citizens, the community, the public.

Legal Actions and Accountability

And in this case, you breached that duty by allowing this individual to get so schlockered that they fell down the stairs causing injuries to innocent fans and therefore those fans can sue the drinking party and they can sue the vendor who provided it and possibly even the security groups.

So understand that just because it’s at a big business venue and you have something that happens by one individual does not mean that that venue is off the hook. They can be held liable.
