What to Do in an Amusement Park Accident?

I’ve done several talks about amusement parks and when we did so we were kind of in the abstract about amusement parks far away where you see them on CNN videotapes of things that are horrific and scary like the upside-down wheel coaster, roller coaster I should say. But now it’s going to come even closer to home because of the news about the new project, the Heartland development, the American Heartland development in Vanina.

We’re going to have like a Disney World or an equivalent. My understanding is Silver Dollar City may be looking at putting in a park as well in northeastern Oklahoma around Cherokee County. I haven’t heard much about that yet but I heard that yesterday.

Liability of Amusement Parks

Are they liable if you get hurt? The answer is absolutely yes. They are regulated by very strict state guidelines and they’re regulated by very strict federal guidelines. They have to not only certify that that machine, that ride, that attraction is safe for the public, but they also have to certify that the operators are trained to properly operate that machinery as well as maintain that ride or machinery.

So when you go to an amusement park, if something happens, don’t wait. If somebody got hurt on the roller coaster or in some other ride or in a slip and fall or trip and fall, or anything of that type, there can be a liability for that on the amusement park operator.
