Understanding your rights in an Uber accident.

What Do You Do if You Get in a Car Accident While in an Uber or Lyft?

What do you do when you take Uber or Lyft and there’s a motor vehicle accident? This topic is near and dear to my heart because in recent months due to some neuropathy in my legs, I’m having to use a walker increasingly and I’ve been discouraged from driving. So I’m using Uber to and from work every day. So out of curiosity, I decided to look into that. What happens if you’re in Uber and in an accident?

My name is Mike Ashworth or Michael Ashworth and I’m the head of the Personal Injury Division for Wirth Law Office. My reasoning for this today is that if you’re in an Uber, you don’t have to worry about exposure in an accident to insurance because Uber has what’s called a commercial general liability policy. Commercial general liability policy. That means when you’re in an Uber unit and the Uber unit is functioning as an Uber unit, they are in an accident, then Uber will cover your injuries.

Now it’s very important even though you’re in an Uber and they have their own protocols in an accident, it’s important you follow your protocol in an accident. Number one, make sure you’re okay. Number two, see if the driver’s okay. Number three, take out your phone, your smartphone and take photographs. Number four, if you need assistance or you’re not sure if you need assistance, you let somebody else open the door and let somebody assist you out. To continue taking pictures. Everybody you talk to, take a picture, get their name and if you can, write down or if you can dictate it to your phone, just do a little blurb after you’ve talked to them. Talk to Jane Doe, who said she saw the whole thing and that the car behind us failed to brake and hit us from behind. Document everything.

What to Do After the Accident

Go to the doctor. But now Uber’s going to have you fill out reports as well for their protocols and that’s perfectly proper. Do it. Fill out everything they ask you. Answer the questions fully. If you’re asked about fault, I suggest to you, how would you possibly know fault? Unless someone said, oh I’m so sorry, I didn’t see you or I couldn’t stop in time. Well, that goes to fault. These are the types of things you should record and be prepared to talk about. Within two to three days of that, no matter what, whether you’re just taking aspirin or whatever, give us a call. Let us talk to you about it. It may be that you’re entitled to compensation above and beyond that ER visit and that ambulance run or your friend taking you to the hospital.
