What Are the Rights for Individuals with Disabilities in Oklahoma Residential Care Facilities?

Today we’re going to talk a little bit more about residential care. This is a topic that’s going to be fairly frequent. One of the things is that when I say residential care, first thing that pops to mind is nursing homes and the elderly people that are octogenarians 70, 80, like my mother recently was 93. But that’s not all who stay in these facilities.

My name is Michael Ashworth. I’m with Wirth Law Office and I’m here to talk to you today about the other people that may reside in these facilities. My brother is Down syndrome. He’s now 67. But many, many people like Greg that were younger in their 40s and 50s or 30s even sometimes had to go into residential care.

Or one young man I knew a number of years ago, who’s a very bright, very gifted young man, was so severely injured that he could not work with home health. He had to go into a 24-7 care. So in his 30s, vibrant, bright, articulate, somewhat mobile, but not very mobile. He was living in a nursing facility where he was the youngest by probably at least 40 years.

The Rights of Individuals with Disabilities

Individuals with disabilities in Oklahoma residential care facilities are owed the same duty as the elderly. They’re supposed to be treated as well. They’re supposed to, only things that should be done to them are pursuant to a physician’s order. They’re supposed to keep you notified as loved ones and family.

If something happens, like there’s an unexplained fall, they’re supposed to let you know. If there’s a change of condition, they’re supposed to let you know. If oxygen levels or values change, they’re supposed to let you know. If that’s not happening, if you’re not getting the information you need and you feel that your loved one is declining because of the care they’re getting or the care they’re not getting, give me a call at 918-924-5528 and also TulsaPersonalInjuryLawyer.pro.
