It’s summertime, we’re supposed to have fun, but today we’re going to talk about where you go places that are supposed to be fun and all of a sudden they’re not fun. Let’s talk about something known as amusement parks, fairs, those types of things where you’ve got all these attractions for kids that they all want to try.
But what happens? What happens is you’re being invited to a business. That makes you what is called a business invitee. That means the operator of that business and the owner of that business owe you the highest degree of care.
Liability of Owners and Operators

When you get hurt on a ride at an amusement park or when you get hurt at an amusement park because there’s some defect in the walkway. There may be an irregularity, a lip that doesn’t match. It’s not flush. Your child may be going running along, boom, hits that thing and crashes to the face of the earth and they have a cut, a gash, or an injury.
The owner and operator could be liable. The operator most certainly could be liable because they are the ones maintaining the premises. And they’re not allowed to say, well we hire somebody to do that stuff so we’re off the hook. They cannot do what is known as delegating that responsibility. In other words, the buck stops with the operator. That doesn’t mean the owner may not be on the hook as well.
Potential Injuries at Amusement Parks
So if you are at an amusement park or anything that has attractions for kids or for people in general and something happens, there’s a fall, something hits you on the head that has fallen from above you, somebody’s on the ferris wheel, they throw something off the ferris wheel at the ground. These are all circumstances that happen from time to time and they can cause injury.
