You’re getting ready for the 4th of July or some other big event. You’re at the grocery store with a list that’s approximately 16 feet long. You’re doing your due diligence looking for the right hot dogs, the right burgers, the right buns, the right condiments and everything else.

You’re going down the frozen food section and someone’s left one of the doors open to the case and it’s beginning to leak out onto the floor or maybe a coffin case. A coffin case is kind of like a big bathtub looking container where you lift from the top and it’s leaking. Now again, you’re going to be looking down the sides of the aisle for what you need. You’re not going to be looking down at the floor. And you slip and you fall and you go down hard. That’s known as a premises liability case of slip and fall.

Documenting the Incident

If you have a camera with you, a smartphone, take pictures of everything you can, all 360, the case, the water, yourself, the shopping cart, everything. An employee is likely going to be coming up very quickly to try to assist you and they should call an assistant manager or manager. When that happens, they should assist you in getting you up, take you into the office, ask you what happened, and have you file an incident report.

If they ask you if you’re hurt, the truthful answer I suggest is this. I don’t know unless you do know. If you are hurt, say that. But if you don’t know or you’re not sure, you’re not hurting yet, allow for the fact that most injuries in fall cases or in car wreck cases, they don’t start the first day because the adrenaline’s flowing. In a store fall, you tend to be embarrassed sometimes. You don’t really want to think about it or dwell on it. But you won’t know until you go to get to see your doctor.
